Welcome to the Statistical Society of Kenya (SSK). These Terms and Conditions ("Terms") govern your membership with the SSK and your use of our website and Member Management System (collectively, "the Platform"). By accessing or using the Platform, applying for, or renewing your membership, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Platform or apply for/maintain SSK membership.
1. Introduction to SSK
The Statistical Society of Kenya is a professional body dedicated to promoting the advancement of statistical science, its applications, and the interests of statisticians in Kenya. We aim to foster professional development, ethical practice, and knowledge sharing within the statistical community.
2. Acceptance of Terms
By registering for an account, applying for membership, renewing membership, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.
3. Membership Eligibility and Categories
3.1. Membership is open to individuals and institutions interested in the advancement of statistics in Kenya, subject to meeting the criteria for specific membership categories as defined by the SSK Constitution and By-laws.
3.2. Membership categories and their respective eligibility criteria, benefits, and annual dues are published on the SSK website and within the Member Management System.
3.3. The SSK reserves the right to approve or reject any membership application or renewal at its sole discretion, without providing reasons.
4. Membership Obligations
4.1. Adherence to Constitution and By-laws:
Members must abide by the SSK Constitution, By-laws, Code of Conduct, and any other policies or regulations adopted by the Society.
4.2. Ethical Conduct:
Members are expected to uphold the highest standards of professional and ethical conduct in all their statistical work and interactions within the Society.
4.3. Dues Payment:
Members must pay their annual membership dues promptly by the stipulated deadlines to maintain active membership status and access member benefits. Failure to pay dues may result in suspension or termination of membership.
4.4. Accurate Information:
Members must provide accurate, complete, and current information during application, renewal, and when updating their profile on the Platform.
4.5. Confidentiality:
Members must respect the confidentiality of information shared within the Society's private forums or events, where explicitly stated.
4.6. Use of Platform:
Members agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Platform by any third party.
5. Use of the Website and Member Management System
5.1. Account Security:
You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account. You agree to notify SSK immediately of any unauthorized use of your account.
5.2. Prohibited Conduct:
You agree not to:
- Use the Platform for any illegal or unauthorized purpose.
- Engage in any activity that could damage, disable, overburden, or impair the Platform or interfere with any other party's use of the Platform.
- Attempt to gain unauthorized access to any part of the Platform, other members' accounts, or computer systems or networks connected to the Platform.
- Upload or transmit any viruses, malware, or other harmful code.
- Post or transmit any content that is unlawful, defamatory, obscene, offensive, or otherwise objectionable.
- Use the Platform to send unsolicited communications (spam).
5.3. Content Submission:
Any content you submit to the Platform (e.g., forum posts, event registrations, profile information) must be accurate, lawful, and not infringe on the rights of others. By submitting content, you grant SSK a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and distribute such content for the purposes of operating and promoting the Society.
6. Intellectual Property
6.1. All content on the Platform, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of SSK or its content suppliers and protected by Kenyan and international copyright laws.
6.2. The SSK name, logo, and other trademarks are the property of SSK. You may not use these without prior written permission from SSK.
6.3. You may access and use the Platform for your personal, non-commercial use related to your SSK membership. Any other use, including reproduction, modification, distribution, transmission, republication, display, or performance, without the prior written consent of SSK, is strictly prohibited.
7. Disclaimers and Limitation of Liability
7.1. No Warranties:
The Platform and all content, materials, and services provided on or through the Platform are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
7.2. Limitation of Liability:
To the fullest extent permitted by law, SSK, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- your access to or use of or inability to access or use the Platform;
- any conduct or content of any third party on the Platform;
- any content obtained from the Platform; and
- unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
8. Termination of Membership
8.1. By Member:
You may terminate your membership at any time by notifying SSK in writing.
8.2. By SSK:
SSK reserves the right to suspend or terminate your membership and access to the Platform, with or without notice, for any reason, including but not limited to:
- Violation of these Terms or any SSK policy.
- Non-payment of membership dues.
- Conduct deemed detrimental to the interests or reputation of the SSK.
- Breach of the SSK Constitution or By-laws.
8.3.
Upon termination, your right to use the Platform and access member benefits will immediately cease.
9. Dispute Resolution
Any dispute or claim arising out of or in connection with these Terms, membership, or the use of the Platform shall be resolved through good faith negotiations between the parties. If a resolution cannot be reached, the dispute shall be submitted to mediation. If mediation fails, the dispute shall be referred to arbitration in accordance with the Arbitration Act, 1995 of Kenya.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law principles.
11. Amendments to Terms
SSK reserves the right to modify or replace these Terms at any time. We will notify you of any changes by posting the new Terms on the Platform and updating the "Effective Date" at the top. Your continued use of the Platform or membership after any such changes constitutes your acceptance of the new Terms.
